The decades long moral panic over sexual assault and sex abuse of minors, together with the triumph of me-tooist ideology and fuelled by it, has had at least three massive impacts on the justice system. First, we have moved from a “never believe the complainant” position to an “always believe the complainant” position. The new version just as bad as the old.
I am deeply disturbed by the verdict ‘on the balance of probabilities’ that Lehrmann is guilty. How does that constitute a guilty verdict based on evidence not probability. ‘Not proven’ is the best anyone could do. But sadly we don’t have that option. I was totally shocked the other night when Bolt after pointing out channel 10 and Lisa Wilkinson came off badly not being exonerated which is true, he then launched into - ‘you rapist Bruce Lehrman’ and continued on with more comment. The balance of probabilities is not something you can base an accusation lke that or Justin Quill’s dreadful tirade against Bruce Lehrman. I don’t know and nobody will know what happened and that is all we can say. The presumption of innocence needs to be restored.
Re the Higgins / Lehmann fiasco - All this expensive trouble could have been avoided if they had both been given a a swift kick in the backside out of their jobs. They were both at fault.
And the judge in the defamation case stated that Higgins had definitely been raped. How the hell would he know?

I sat on a jury where a young man was accused of raping his step daughter in a car.
No evidence was presented to support the charge
1/ 2 way through we had the charges doubled, he did it twice. This was never mentioned again.
The only accuser was a mad woman friend of the mothers and totally unbelievable.
The about 13 yr old girl on video camera had nothing to say.
The police prosecuter did not seem concerned or to believe his own words. Just going through the motions.
The judge after 4 days basically cast doubt on the charges.
The oldest women on the jury went from wanting the man castrated or hung on the 1st day to voting him innocent as we all did.
What a complete waste of police, judge, jury, lawyers, court staff, time and money. To say nothing of the accused man.
Only the mad mothers friend believed in the charges.
I trust we made the right decision.
Why did it come to court at all?
